These Terms & Conditions ("Terms") form a binding agreement between you ("you", "user") and Essex County Newark Probate Preservation ("ECNPP", "we", "us", "our"). By accessing https://ecnpp.org, contacting us, or using any of our services, you agree to these Terms. If you do not agree, do not use the website or our services.

1. Nature of services; not legal advice

ECNPP is a community-based consulting and family-advocacy organization located in Newark, New Jersey. We help Essex County residents understand and navigate the Surrogate's Court probate and administration process. ECNPP is not a law firm, our staff and consultants are not licensed to practice law, and nothing on this website or in any communication with us constitutes legal advice. 2. No attorney-client relationship

Use of this website, submission of an intake form, or any other contact with ECNPP does not create an attorney-client relationship and is not protected by the attorney-client privilege. With your written consent, ECNPP may refer you to an independent attorney licensed by the Supreme Court of New Jersey; any attorney-client relationship is formed solely between you and that attorney.

3. Free services and grants

ECNPP's consulting services are provided at no cost to qualifying Essex County families. Eligibility for grant or financial-assistance programs is determined case-by-case in our sole discretion and is not guaranteed. When approved, grant funds are disbursed directly to courts, licensed attorneys, or third-party vendors on your behalf — never paid in cash or transferred to applicants.

4. Eligibility & accuracy of information

You must be at least 18 years old to use our services. You agree to provide accurate, current, and complete information. ECNPP is not responsible for outcomes arising from inaccurate, incomplete, or fraudulent information you supply. Knowingly providing false information to obtain a grant or service may be reported to the appropriate authorities.

5. Communications consent (calls, texts, email)

By submitting your contact information, you expressly consent — under the federal Telephone Consumer Protection Act (TCPA, 47 U.S.C. § 227) and applicable New Jersey law — to be contacted by ECNPP at the phone number(s) and email address you provide, including by autodialed or pre-recorded calls and SMS/text messages, regarding your inquiry, the services you requested, eligibility for assistance, and related follow-up. Consent is not a condition of receiving services. Standard message and data rates may apply. You can opt out of texts at any time by replying STOP, or out of email by clicking unsubscribe or emailing support@ecnpp.org. Calls may be recorded for quality assurance with notice as required by law.

6. Intellectual property

All content on this website — including text, graphics, logos, the ECNPP crest, and downloadable resources — is owned by or licensed to ECNPP and is protected by U.S. copyright and trademark law. You may view and print pages for personal, non-commercial use only. You may not reproduce, distribute, or create derivative works without our prior written permission.

7. Acceptable use

You agree not to (a) use the website for any unlawful purpose, (b) attempt to gain unauthorized access to our systems or other users' data, (c) submit false, defamatory, or harassing content, or (d) interfere with the operation of the website. We may suspend or terminate your access at any time for any violation.

8. Third-party links and services

The website may contain links to third-party websites, attorneys, or partner organizations. ECNPP does not control and is not responsible for the content, accuracy, or practices of any third party, and inclusion of a link does not imply endorsement.

9. Disclaimer of warranties

The website and our services are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement, to the maximum extent permitted by New Jersey law.

10. Limitation of liability

To the maximum extent permitted by law, ECNPP and its directors, employees, volunteers, and consultants shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of this website or our services. Nothing in these Terms limits any liability that cannot be limited under New Jersey law, including under the New Jersey Consumer Fraud Act (N.J.S.A. 56:8-1 et seq.) where applicable.

11. Indemnification

You agree to indemnify and hold harmless ECNPP from any claims, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the website, or your violation of any law or third-party right.

12. Governing law and venue

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws principles. You and ECNPP agree that any dispute arising from these Terms or your use of the website shall be brought exclusively in the state or federal courts located in Essex County, New Jersey, and you consent to the personal jurisdiction of those courts.

13. Severability and entire agreement

If any provision of these Terms is held unenforceable, the remaining provisions shall remain in full force and effect. These Terms, together with our Privacy Policy and Legal Disclaimer, constitute the entire agreement between you and ECNPP regarding the website.

14. Changes to these Terms

We may update these Terms from time to time. The "Effective date" above reflects the most recent change. Continued use of the website after changes are posted constitutes your acceptance of the updated Terms.
