This Privacy Policy describes how Essex County Newark Probate Preservation ("ECNPP", "we", "us", "our") collects, uses, discloses, and protects information when you visit https://ecnpp.org or interact with our consulting services. We are committed to handling your information in accordance with the New Jersey Data Privacy Act ("NJDPA", N.J.S.A. 56:8-166.4 et seq.), the New Jersey Identity Theft Prevention Act (N.J.S.A. 56:8-161 et seq.), and other applicable federal and state privacy laws.
1. Information we collect
We collect only the information needed to help you. This may include:
- Contact information you provide — name, phone number, email address, preferred language.
- Case information you share — the decedent's name, county, your relationship to the estate, and a brief description of your situation.
- Sensitive information only if you choose to share it (for example, financial-hardship details for grant eligibility). We do not request government IDs through this website.
- Technical data automatically collected when you visit the site — IP address, browser type, pages viewed, and timestamps — used to keep the site secure and functional.
2. How we use your information
- To respond to your inquiry and provide consulting assistance.
- To evaluate eligibility for grant or financial-assistance programs.
- With your consent, to refer you to an independent licensed New Jersey attorney or partner organization.
- To comply with legal obligations and protect against fraud or abuse.
- To improve our website, services, and educational content.
We do not use your personal information for targeted advertising, and we do not sell your personal information or sensitive data, as those terms are defined under the NJDPA.
3. How we share information
We share information only as follows:
- With your consent — for example, with a licensed attorney or partner organization you authorize us to contact.
- With service providers bound by confidentiality obligations and used only to operate our website (such as hosting, database, and email infrastructure providers).
- For legal reasons — when required by law, subpoena, court order, or to protect the rights, safety, or property of ECNPP, our users, or the public.
4. Data retention
We retain your information only as long as reasonably necessary for the purposes described above, to comply with legal and recordkeeping obligations, and to resolve disputes. When information is no longer needed, we delete or de-identify it using commercially reasonable methods.
5. Data security and breach notification
We use reasonable administrative, technical, and physical safeguards to protect your information, including encryption in transit (TLS), access controls, and least-privilege database policies. No system is perfectly secure and we cannot guarantee absolute security. If a security breach involving your personal information occurs, we will notify you and the New Jersey Division of State Police as required by the New Jersey Identity Theft Prevention Act.
6. Your privacy rights (New Jersey residents)
As a New Jersey resident, you have the following rights under the NJDPA:
- Right to confirm and access the personal data we process about you.
- Right to correct inaccurate personal data.
- Right to delete personal data we hold about you.
- Right to data portability — to obtain a copy of your data in a portable, readily usable format where technically feasible.
- Right to opt out of (i) targeted advertising, (ii) the sale of personal data, and (iii) profiling that produces legal or similarly significant effects. ECNPP does not engage in any of these activities.
- Right to non-discrimination for exercising any of the rights above.
- Right to appeal a denial of any request — see Section 8 below.
To exercise any of these rights, email support@ecnpp.org or call (201) 466-5471. We will respond within 45 days as required by the NJDPA, with one additional 45-day extension where reasonably necessary. We may need to verify your identity before fulfilling certain requests.
7. Authorized agents
You may designate an authorized agent to make a privacy request on your behalf. We may require written authorization and proof of the agent's identity, and we may verify your identity directly.
8. Appeals
If we deny your privacy request, you may appeal by replying to our response or emailing support@ecnpp.org with the subject line "Privacy Appeal" within 60 days. We will respond within 45 days. If your appeal is denied, you may submit a complaint to the New Jersey Division of Consumer Affairs at njconsumeraffairs.gov.
9. Communications consent and opt-out
By submitting your contact information, you consent to be contacted by ECNPP by phone, SMS/text, or email about your inquiry. Consent is not a condition of receiving services. You can opt out of text messages at any time by replying STOP, opt out of email by clicking unsubscribe or emailing us, and request to be placed on our internal do-not-call list at any time.
10. Cookies and tracking
We use only essential cookies and minimal analytics needed to operate and secure the website. We do not use third-party advertising cookies, and we honor recognized opt-out preference signals such as Global Privacy Control (GPC) where applicable.
11. Children's privacy
Our services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. We do not knowingly process the data of consumers we know to be between 13 and 17 for targeted advertising or sale, consistent with the NJDPA. If you believe a child has provided us with personal information, contact us and we will delete it.
12. Out-of-state and international users
ECNPP serves Essex County, New Jersey. If you access this website from outside New Jersey, your information will be processed in the United States under U.S. and New Jersey law.
13. Changes to this policy
We may update this Privacy Policy from time to time. The "Effective date" above reflects the most recent change. Material changes will be highlighted on this page.
